Terms of Service

Effective June 17, 2026

These Terms of Service ("Terms") are a binding agreement between you and TRP App, LLC ("The Run Plan," "we," "us") governing your use of The Run Plan mobile app and website (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

1. Eligibility

You must be at least 18 years old (or the age of majority where you live) to use the Service. By using it, you represent that you meet this requirement.

2. Your account

You are responsible for the information you provide, for keeping your login credentials secure, and for all activity under your account. Provide accurate information so we can build an appropriate plan for you.

3. The Service

The Run Plan provides AI-assisted running training plans, coaching notes, and related features. Plans and guidance are generated from the information you provide and connected data, and are general fitness recommendations — not professional, medical, or individualized clinical advice.

4. Health disclaimer & assumption of risk

The Run Plan is not a medical provider and does not provide medical advice, diagnosis, or treatment. Consult a qualified physician before beginning, changing, or continuing any exercise program, especially if you have a medical condition, are injured, are pregnant, or have any concern about your health. Running and physical training carry inherent risks, including injury.

You participate voluntarily and assume all risks. Stop exercising and seek medical attention if you experience pain, dizziness, shortness of breath, or other symptoms. You are solely responsible for deciding whether any workout is appropriate for you on a given day.

5. Subscriptions, billing & cancellation

Some features require a paid subscription. Subscriptions are sold through the Apple App Store and/or other processors (RevenueCat, Stripe) and are billed in advance on a recurring basis. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. Manage or cancel your subscription in your App Store account settings. Except where required by law, payments are non-refundable; App Store purchases are subject to Apple's refund policies.

6. Acceptable use

You agree not to:

  • Use the Service unlawfully or in violation of these Terms;
  • Reverse engineer, scrape, or attempt to access non-public areas or other users' data;
  • Interfere with, disrupt, or overload the Service; or
  • Resell or commercially exploit the Service without our permission.

7. Your content

You retain ownership of the information you submit (e.g., check-ins, notes). You grant us a license to use it as needed to operate and improve the Service, as described in our Privacy Policy.

8. Intellectual property

The Service, including its software, content, coaching methodology, and branding, is owned by TRP App, LLC and its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial use.

9. Third-party services

The Service integrates with third parties (e.g., Apple Health, Garmin, COROS, Strava, Terra, payment processors). Your use of those services is governed by their terms, and we are not responsible for them.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that any plan will produce specific results.

11. Limitation of liability

To the maximum extent permitted by law, TRP App, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of (or inability to use) the Service, including any injury. Our total liability is limited to the greater of the amount you paid us in the 12 months before the claim or USD 100.

12. Indemnification

You agree to indemnify and hold harmless TRP App, LLC from claims arising out of your use of the Service or your violation of these Terms.

13. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Provisions that by their nature should survive termination will survive.

14. Changes

We may update the Service and these Terms. We will post the updated Terms here and revise the effective date; continued use after changes means you accept them.

15. Governing law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules. [Add venue / arbitration / class-action-waiver provisions as advised by counsel.]
